Terms of Service

The agreement between you and MarketBrain, written to match what the product actually does today.

This document is an unreviewed draft. It was written to describe what MarketBrain actually does today, but it has not been reviewed by a lawyer, it is not legal advice, and it is not a finished agreement. A qualified attorney needs to review and approve it before MarketBrain relies on it or launches publicly. Some sections are still marked as open questions and do not yet reflect a decision.

1. Agreeing to these terms

These terms are an agreement between you and MarketBrain. By creating an account, using the free tier, or subscribing to a paid plan, you agree to them. If you do not agree, please do not use MarketBrain.

We have tried to write this in plain language rather than dense legal boilerplate. Where something is not settled yet, we say so instead of guessing.

2. What MarketBrain is

MarketBrain is a daily research feed for e-commerce sellers. Once a day we gather trending product listings from TikTok Shop and, for each product, generate a supplier search link, three marketing angles, and three ready-to-film video scripts using an AI model. The result is presented as a ranked feed you can browse.

MarketBrain is a research and idea-generation tool. It is not a marketplace, a supplier, a fulfillment service, a payment processor for your business, or a financial, legal, or tax advisor. We do not sell products to you, source products for you, or handle any part of your own store.

3. Your account

You need an account to use MarketBrain. You can sign in with an email address and a password, with a one-time magic link sent to your email, or with a Google account. Accounts and sign-in are handled through Supabase Auth.

You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account. MarketBrain is built for business use, not for personal or household use.

You are responsible for keeping your password and your email inbox secure, and for everything that happens under your account. Tell us promptly if you believe someone else has gained access to it. Please give accurate information when you sign up, and keep your email address current, since it is how we reach you and how account recovery works.

4. The free tier

MarketBrain has a free tier. Today's top 3 trending products are fully unlocked for every signed-in user, including the supplier link, the marketing angles, and the video scripts for those three products. No card is required and there is no time limit on it.

The rest of the daily feed is visible but locked. Locked rows do not include the supplier link, angles, or scripts.

The free tier is offered as it exists today. We may change what it includes in the future, though we would not do that quietly to existing users. See the section on changes to the service below.

5. Paid subscriptions and billing

A paid subscription unlocks the entire daily feed, every product with its supplier link, marketing angles, and video scripts. There is one plan and one level of access. Monthly and annual are a billing choice, not a feature choice.

There are two billing options: $39 per month, or $348 per year (which works out to $29 per month). Prices are in US dollars and do not include any taxes that may apply to you.

Payments are processed by Stripe. Checkout happens on a Stripe-hosted page, and your card details go directly to Stripe. MarketBrain never sees, handles, or stores your card number. What we store is a Stripe customer identifier, a subscription identifier, your subscription status, and the date your current billing period ends.

Subscriptions renew automatically at the end of each billing period, monthly or annually depending on which you chose, until you cancel. You are authorizing that recurring charge when you subscribe.

You can cancel at any time from the Stripe billing portal, reachable from your account. There is no cancellation email to send and no retention flow to get through. Cancelling does not cut off your access immediately: you keep full access through the end of the period you already paid for, and after that your account reverts to the free tier. Your account itself is not deleted when you cancel.

There is no free trial of the paid plan. The free tier is how you evaluate MarketBrain before paying.

There is no in-app way to switch between monthly and annual billing today. To switch, cancel your current plan in the billing portal and subscribe again on the other option.

Open question, needs a real decision

Refunds are not defined yet. Nothing in the product issues refunds automatically, and no refund policy has been decided. The Product Architect needs to set an actual policy (for example: no refunds for partial periods, a 7 or 14 day money-back window, or case-by-case at our discretion), and it must match how Stripe is actually configured. Until that is decided this section deliberately makes no promise either way.

6. How you may use MarketBrain

Your subscription is for you and your own business. Please use it that way.

  • Do not scrape, crawl, bulk-export, or automatically harvest the MarketBrain feed or any part of it.
  • Do not resell, republish, syndicate, or redistribute MarketBrain's data, supplier links, marketing angles, or video scripts as a product or service of your own, including as part of a competing research tool.
  • Do not share your account credentials, or resell access to your account, so that people who have not paid can use it.
  • Do not attempt to bypass the paywall, access locked rows you have not paid for, or probe our systems, APIs, or database for weaknesses.
  • Do not send automated traffic that puts unreasonable load on the service.
  • Do not use MarketBrain to break the law, to infringe someone else's rights, or to violate the rules of the marketplaces you sell on.

7. Who owns what

MarketBrain owns the service: the site, the software, the design, the ranking and enrichment logic, and the AI prompts behind it. Nothing in these terms transfers that to you.

The marketing angles and video scripts generated for products you have unlocked are yours to use in your own business. You can film them, adapt them, and run ads with them without paying us anything extra or crediting us. That permission covers using the output. It does not include reselling the output itself as a content product, or reproducing the feed as a whole.

Because these angles and scripts are generated by an AI model from a short product description, other users may receive similar output for the same or a similar product. We cannot promise the text you receive is unique to you, and we make no claim about whether AI-generated text is protectable by copyright.

8. AI-generated content

The supplier search links, marketing angles, and video scripts are generated by an AI model. AI output can be wrong, generic, or occasionally nonsensical, and it can state something confidently that is not true.

Review anything you get from MarketBrain before you use it. You are responsible for whether your own marketing claims are truthful, legally compliant, and appropriate for your audience and your platform, particularly for advertising rules, health or safety claims, and any required disclosures. MarketBrain does not review your ads and does not approve them.

9. Third-party marketplaces and suppliers

MarketBrain is independent. It is not affiliated with, endorsed by, or sponsored by TikTok, TikTok Shop, ByteDance, Amazon, AliExpress, or any other marketplace. Those names are used only to describe the marketplaces our data covers.

Supplier links are AI-generated search links into a third-party marketplace. They are a starting point for your own research, not a vetted recommendation. We do not verify, endorse, inspect, or have any relationship with the suppliers those searches return. Anything you buy from a supplier is a transaction between you and that supplier, and their terms apply, not ours. Vetting a supplier, the product, its quality, and its legal compliance is on you.

10. About the demand data

The sold counts and demand figures shown on each product are TikTok Shop's own publicly displayed numbers, gathered once a day. That is the same source every tool in this category uses, and there is no more official number above it.

We show these figures as a demand signal, not as an independently audited or verified statistic. We do not calculate them, we do not confirm them, and we cannot guarantee that the platform's numbers are accurate, current, or complete. Numbers can also be out of date by up to a day, since the feed is refreshed daily rather than in real time.

MarketBrain does not promise that any product will sell, that a trend will continue, or that you will make money. Nothing in the feed is a forecast, a guarantee of results, or business or financial advice. Selling online carries real risk, including losing money on inventory and ad spend, and those decisions and their outcomes are yours.

11. Service availability and changes

We aim to keep MarketBrain running and refreshed daily, but we do not promise uninterrupted availability. The feed depends on third-party services and on data published by marketplaces we do not control. If an upstream source changes or a daily run fails, the feed may show the previous day's data or be temporarily incomplete.

We may add, change, or remove features. If we make a change that meaningfully reduces what a paid subscription includes, we will tell subscribers by email or in the app before it takes effect, and you can cancel if you do not want to continue.

12. Ending your access

You can stop using MarketBrain at any time, and you can cancel a paid subscription at any time from the billing portal.

We may suspend or close an account that breaks these terms, particularly the acceptable use rules above, or that we reasonably believe is being used fraudulently or in a way that harms the service or other users. Where it is reasonable to do so, we will warn you first and give you a chance to fix the problem. If we close a paid account for a reason that is not your fault, we will deal with the unused portion of your current billing period fairly, subject to the refund policy that still needs to be decided above.

The sections covering ownership, data accuracy, disclaimers, and limitation of liability continue to apply after your account ends.

13. Disclaimer of warranties

MarketBrain is provided as is and as available, without warranties of any kind, whether express or implied. To the fullest extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure, that the data or AI-generated content will be accurate, complete, or current, or that using MarketBrain will produce any particular business result.

14. Limitation of liability

To the fullest extent the law allows, MarketBrain is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost sales, lost data, wasted ad spend, or unsold inventory, even if we were told such damages were possible.

To the fullest extent the law allows, our total liability for any claim relating to MarketBrain is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred US dollars.

Some jurisdictions do not allow certain limitations of liability or exclusions of implied warranties. Where that is the case, those limits apply only as far as the law allows, and nothing here limits liability that cannot legally be limited.

15. Governing law and disputes

This section is not filled in yet. A real choice of governing law and venue has to come from the business, not from a template, and getting it wrong has real consequences.

Open question, needs a real decision

The Product Architect needs to decide the governing jurisdiction (the country, and the state or province) and where disputes are resolved, based on where the business is actually established. That choice also drives a related decision on whether to include an arbitration clause and a class-action waiver, which are common in US consumer SaaS terms but are a real legal decision with tradeoffs, not a formatting choice. Nothing is invented here on purpose. This needs a lawyer's input alongside the rest of this document.

16. Changes to these terms

We may update these terms as MarketBrain changes. When we do, we will change the date at the top of this page. If a change materially affects your rights or what you are paying for, we will give you notice by email or in the app before it takes effect.

Continuing to use MarketBrain after a change takes effect means you accept the updated terms. If you do not accept them, cancel your subscription and stop using the service.
